Terms and conditions – Guatemala Tierra Maya

Plain-English summary (not part of the Terms): We help you plan and arrange travel. We act as an intermediary, so the airlines, hotels and operators who actually deliver services are responsible for their own performance. We're not a government website. Pay attention to the payment, cancellation and liability sections below.

1. Acceptance of these Terms

These Terms of Service ("Terms") form a binding agreement between you ("you", "the customer", "the traveler") and Guatemala Travel Experience S.R.L., an Argentine limited liability company (Sociedad de Responsabilidad Limitada) that operates the website guatemalatierramaya.com under the trading name "Guatemala Landing" ("Guatemala Landing", "we", "us", "our"). By accessing or using the website, submitting an enquiry, or booking any service, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the website or our services.

2. Our role

Guatemala Landing provides travel information and acts as an intermediary and travel-arrangement service that helps customers plan trips and connects them with independent third-party suppliers (such as airlines, hotels, transport providers, guides and tour operators).

Unless expressly stated in writing, we do not own, operate, control or directly provide transport, accommodation, tours or other travel services. Those services are supplied by independent third parties and are subject to their own terms and conditions.

3. No government affiliation

Guatemala Landing is a private, independent business. We are not affiliated with, endorsed by, authorized by, or operated by any government agency or official body, including the Government of Guatemala. Any official government documents, forms or services referenced on the website can be obtained directly from the relevant official sources, in many cases free of charge. Any fees we charge are solely for our own optional information, planning and assistance services, and never for the government documents themselves.

4. Eligibility

You must be at least 18 years old and able to form a legally binding contract to book services. By booking, you confirm that the information you provide is accurate and that you are authorized to make the booking for yourself and any other travelers in your party.

5. Enquiries & bookings

Submitting an enquiry (for example through our forms or by email) is a request, not a confirmed booking.
Prices, itineraries and availability shown on the website are indicative and may change until a booking is confirmed by us in writing.
A booking is only confirmed once we have accepted it in writing and any required payment has been received.
We reserve the right to decline or cancel any enquiry or booking at our discretion, including where details are inaccurate, where suppliers are unavailable, or where we reasonably suspect fraud or misuse.

6. Pricing & payment

Prices are quoted per the confirmed itinerary and are per person based on two people sharing unless stated otherwise.
Unless agreed otherwise in writing, bookings are typically secured with a deposit, with the remaining balance due before the start of travel. Exact amounts and due dates are confirmed with your personalized quote.
Prices may exclude items such as international flights, travel insurance, visas or government fees, tips, and personal expenses, unless expressly listed as included.
Quoted prices may be subject to change due to factors outside our control (for example currency fluctuations, supplier price changes or taxes) before a booking is confirmed.
All payments are processed in the currency stated at the time of booking. You are responsible for any bank or currency-conversion fees charged by your provider.

7. Cancellations & changes

By you

Cancellation and change terms depend on the suppliers involved and are set out in your written booking confirmation. Deposits and amounts already paid to suppliers may be non-refundable. Where we have incurred costs or charged for planning and assistance work already performed, those amounts may also be non-refundable.

By us or suppliers

Occasionally, services may be changed or cancelled by us or by a supplier for reasons including force majeure, safety, weather, or supplier failure. Where reasonably possible we will offer a comparable alternative or work with you and the relevant suppliers on available options. Our responsibility in such cases is limited as described in the Limitation of Liability section below.

8. Your responsibilities

Ensuring you hold valid travel documents, passports, visas and any required entry permissions, and meeting all entry, health and immigration requirements for your trip.
Obtaining adequate travel insurance. We strongly recommend comprehensive travel insurance; travel without it is at your own risk.
Arriving on time for transport and activities, and following the lawful instructions of guides and suppliers.
Behaving responsibly and respecting local laws, customs and the safety of yourself and others.
Providing accurate information, including any medical, dietary or accessibility needs, in advance.

9. Third-party services

Travel services are delivered by independent suppliers who are responsible for the services they provide and for their own acts and omissions. Your use of those services is subject to the suppliers' own terms and conditions. To the fullest extent permitted by law, Guatemala Landing is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any third-party supplier, or for any personal injury, death, property damage, delay or other loss resulting from them.

The website may contain links to third-party websites that we do not control and are not responsible for.

10. Intellectual property

All content on the website — including text, graphics, logos, images and design — is owned by or licensed to Guatemala Landing and is protected by applicable intellectual-property laws. You may not copy, reproduce, republish or exploit any part of the website without our prior written permission.

11. Disclaimers

The website and our services are provided "as is" and "as available", without warranties of any kind, whether express or implied, except those that cannot be excluded under applicable law. We do not warrant that the website will be uninterrupted or error-free, or that information on it (including prices, descriptions and availability) is always complete or current.

Travel involves inherent risks. You acknowledge that activities such as hiking, volcano treks, water activities and travel in remote areas carry risks, and you choose to participate at your own risk.

12. Limitation of liability

To the maximum extent permitted by applicable law:

Guatemala Landing, its owners and operators will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, enjoyment or goodwill, arising out of or relating to your use of the website or our services.
Our total aggregate liability for any claim arising out of or relating to these Terms or our services will not exceed the total amount of fees you actually paid to Guatemala Landing (i.e. our own service fees, excluding amounts passed through to suppliers) for the specific booking giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including, where applicable, liability for fraud, for death or personal injury caused by our own negligence, or any statutory consumer rights you may have. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and you may have additional rights under local law.

13. Indemnification

You agree to indemnify and hold harmless Guatemala Landing and its owners and operators from any claims, losses, liabilities and reasonable expenses (including legal fees) arising from your breach of these Terms, your violation of any law, or your misuse of the website or services, except to the extent caused by our own negligence or wrongdoing.

14. Governing law

These Terms and any dispute arising out of or relating to them or our services are governed by the laws of the Argentine Republic, without regard to conflict-of-laws principles. You agree to submit to the jurisdiction of the competent ordinary courts of the City of Buenos Aires (Ciudad Autónoma de Buenos Aires), to the extent permitted by applicable law. Nothing in this section limits any mandatory consumer-protection rights you may have under Argentine law (including Ley 24.240 de Defensa del Consumidor) or under the laws of your country of residence.

15. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest version. Material changes take effect when posted, and your continued use of the website after changes are posted constitutes acceptance of the revised Terms.
